About this policy

Headland Financial is practice based in Manly, NSW. Headland Financial operates under Chapter Two Holdings Pty Ltd (ABN 45 607 596 449), which holds Australian Credit Licence 531408 and is a member of the Finance Brokers Association of Australia (FBAA) and the Australian Financial Complaints Authority (AFCA).

This policy explains how we collect, use, hold and disclose your personal information, and how we comply with the Australian Privacy Principles (APPs) set out in the Privacy Act 1988 (Cth).

The information we collect

To assess and arrange credit on your behalf we need to collect personal information. The information we ask for will depend on the service you're after, but it typically includes:

  • Identification details (full name, date of birth, residential address, contact details)
  • Financial details (income, expenses, assets, liabilities, savings, employment history)
  • Identity verification documents (driver licence, passport, Medicare card)
  • Credit information and credit reporting body data
  • Details about the property, asset or transaction being financed
  • Details of dependants, partners, guarantors or co-applicants where relevant

We collect this information directly from you wherever practical. With your consent we may also collect it from third parties such as your accountant, employer, lender, conveyancer, real estate agent, financial planner or a credit reporting body.

Why we collect it

We collect personal information so that we can:

  • Assess your borrowing needs and objectives
  • Identify and verify you under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth)
  • Research, compare and recommend suitable credit products
  • Prepare and submit credit applications to lenders on your behalf
  • Manage your application through to settlement and review the loan over its life
  • Send you service updates, annual reviews and (with your consent) relevant marketing
  • Comply with our legal, regulatory and licensing obligations

If you choose not to provide the information we ask for, we may not be able to act for you or recommend a suitable credit product.

Who we share it with

We only share your information where it's necessary for the service you've engaged us for, where you've consented, or where the law requires it. The parties we may share information with include:

  • Lenders, mortgage managers and credit providers
  • Lenders mortgage insurers and valuers
  • Our aggregator (Connective) and its compliance and IT providers
  • Credit reporting bodies
  • Your solicitor, conveyancer, accountant or financial planner (where you've asked us to)
  • Government and regulatory bodies where required
  • Our professional advisers (auditors, lawyers, IT providers) under confidentiality

We do not sell your personal information.

Credit information

With your consent, we obtain credit eligibility information from credit reporting bodies and use it to assess your application. You have rights under Part IIIA of the Privacy Act in relation to credit information held about you, including the right to access it, ask for it to be corrected, and request that a credit reporting body not use your information for direct marketing of credit products.

Anti-Money Laundering and Counter-Terrorism Financing

We are required by law to identify and verify our clients before providing certain services. To meet our obligations under the AML/CTF Act, we collect and retain identification information (and supporting documents) for a minimum of seven years after our relationship with you ends. Sensitive information

We don't generally collect sensitive information. Where it's necessary (for example, where a health condition is relevant to a hardship application or insurance referral), we'll only collect it with your consent and only for the purpose you've consented to.

Marketing communications

From time to time we may use your contact details to send you market updates, rate changes, annual reviews or other content we think you'll find useful. You can opt out at any time by replying to the message or emailing info@headlandfinancial.com.au.

How we store and protect your information

Your information is held within our aggregator's CRM and in cloud-based document storage that uses encryption in transit and at rest. Access is restricted to authorised personnel. We review our security practices regularly and update them when necessary.

Where we use overseas service providers (for example cloud hosting), we take reasonable steps to ensure they handle your information consistently with the Australian Privacy Principles.

Accessing and correcting your information

You can request access to the personal information we hold about you, or ask us to correct it if you believe it's inaccurate, incomplete or out of date. We'll respond within a reasonable time and won't charge an unreasonable fee. In limited circumstances we may refuse access — if we do, we'll explain why in writing.

Government identifiers

We don't use government-issued identifiers (such as Tax File Numbers or Medicare numbers) as our own identifier for you.
